Terms and Conditions

South France village houses Sarl registered at 210 Chemin du Camisard, 30350 Cardet, France, Siret Number 501 215 420 00016, act as booking agents for ¨the Owner¨ of the accommodation. We accept no liability in relation to any contract you “the Guest” enters into for the accommodation or for any services or arrangements you purchase or for the acts or omissions of the Owner or any supplier(s) or other person(s) or party (ies) connected with any arrangements. For all arrangements, your contract will be with the Owner or the relevant third party provider with whom you book any such arrangements, including transport or other facilities. We are not a property management company. If you proceed with booking the accommodation with the Owners through us, then you agree to be bound by the terms and conditions set out in the Booking Conditions below.

We and or the Owner reserve the right to refuse a booking without giving any reason.

Your booking becomes a binding agreement between you “the Guest” and “the Owner” upon receipt by South France village houses . of the completed and signed Booking Form and the payment of the deposit. The signing of the Booking Form constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as printed below. Booking Conditions

To make a Rental Booking.

South France village houses . act as booking agents for the ¨The Owner¨ of the accommodation . Although we are responsible for processing bookings made through us using the Booking Form, your contract for the letting of the property is with the Owner of the property and governed by the terms set out below.

The Guest is advised to make contact (telephone/e-mail) with the Booking Agent to confirm that the property is available for the desired rental period. To make a booking, first complete, sign and return the Booking Form which will be sent to you by email or post together with a copy of the Terms and Conditions. The completed and signed Booking Form confirms details of your booking and details of all relevant parties included in the booking who will be staying at the property. The Terms and Conditions will be the conditions specific to the property you will be renting from the Owner, including provisions such as any applicable breakages deposit, any other charges. Payment of the initial non-refundable deposit – (usually 25% of the total rental cost) – will also be required at this time. Post the signed documents to us at the address provided, together with your deposit monies. You should also confirm your booking request by email. The signed Booking Form and acceptance of the Terms and Conditions constitutes a binding agreement.

The person who signs the Booking Form certifies that he/she is authorised to agree these terms and conditions, the Rental Contract and those terms and conditions specific to the property, on behalf of all persons included on the Booking Form, including those substituted or added at a later date. The signatory must be a member of the party occupying the property and must be 18 years or over. Bookings cannot be accepted from parties of young people less than 18 years of age.

Upon receipt of the booking form and deposit a confirmation will be sent.

We will reserve a property for you for 10 days from the day you confirm your request to proceed with a booking by email. If your deposit payment does not arrive within the 10 days, we cannot guarantee that your booking will be accepted.

Payment

A non-refundable deposit of 25% of the booking price must be paid to us within 10 days of making your provisional reservation. We will hold a property for you for 10 days from the day you confirm your request to proceed with a booking by email. If your deposit payment does not arrive within the 10 days, we cannot guarantee that your booking will be accepted. You can make the payment by bank-to-bank transfer or by credit card . Payment of the balance of your rental is due not less than 8 weeks before the start date of the rental period. Bookings made within 8 weeks of the start date of the rental period require full payment at the time of booking. We and the Owner are entitled to treat your booking as cancelled, with no refund of the deposit, if you fail to pay the balance on time.

Written instructions for arriving at the house will be provided on receipt of the full rental.

Prices

All prices are quoted in € euros per week and are exclusive of any other levy or charge that may be applicable. Our price is for accommodation only, with some inclusive services connected to the property (if applicable) which are noted on each property and in the terms and conditions sent through with the Booking Form. Telephone, electricity, heating, bed linen, and cleaning, may not be included in the rental price and details of this will be set out in the Terms and Conditions of the individual property

There is no telephone provided unless otherwise stated.

Cancellation

Should a cancellation be necessary then your deposit will be lost. Should the cancellation occur after the balance has been paid you will be refunded in accordance with the with the following:

We will endeavour to re-let the property for “the Owner” if a cancellation of a booking is made. Any refunds made (less the deposit) will be subject to a deduction of 100€ made for re-advertising costs and reduced revenues. If the property is unable to be re-let then full amount will be lost.

We strongly advise you to take out holiday travel insurance as soon as your booking is confirmed – this should cover any cancellations for reasons beyond your control. If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim the loss of your deposit from your insurance company, however such claims must be made direct to the insurance company concerned and do not affect the terms of these terms & conditions

If a client does not pay the balance when it becomes due then we reserve the right to cancel the booking and retain the deposit. If you must change or cancel any portion of the accommodation you have already booked, please notify the Owners or their Representative IN WRITING (by fax or letter). The effective date of cancellation is the date we receive written notification, which we will then forward to the Owner directly. No-shows, late arrivals and early departures after your arrival are non-refundable.

Alterations by You

If after we have issued a Booking Confirmation to you, you wish to alter your booking, please let us know immediately. We will endeavour to accommodate your wishes, however you acknowledge that this may not be possible. This service may incur an administration charge of 75€, depending on the changes requested by you. We will notify you of any proposed administration charge at the time you request the required changes to your booking.

Cancellation by the Owner

In the unlikely event that a significant change or cancellation of your booking by the Owner has to be made, or there are major changes to your booking required to be made by us or the Owner due to matters beyond our or the Owner’s reasonable control which are not covered under ‘Force Majeure’ (see below), we will advise you as soon as possible and will endeavour to offer you suitable alternative accommodation. If this is not possible, or you do not wish to accept the alternatives offered, we will give you a complete refund of all monies paid by you to us.

Rental

Properties are let fully furnished and equipped. Additional services are clearly stated in the individual property description.

We and/or the Owner reserve the right to make changes to and correct errors in advertised prices for the rental of the property at any time before your holiday booking is confirmed. We will advise you of any error of which we are aware of at the time of booking.

Security deposit

A security deposit or 500 Euros for the house is required. An amount of 500€ will be reserved on your Credit Card for a period of 30 days from your arrival to cover any damage incurred to the property or its contents or need for additional cleaning. In the case of any damage, degradation or breakages, the amount necessary to restore the property or its contents to its former condition will be taken out of this sum. All normal utilities (except for careless or extremely excessive use of your property’s water supply) are included in your rental price. If the Security Deposit is not sufficient to cover the cost of such utilities and/or services or damage, the Owner is entitled to recover any additional costs from you. Some damages may not be immediately obvious to the Owner upon your departure. The Owner reserves the right to charge you for any damage noted in the property after your departure.

The house is fully furnished and rearranging the furniture or removing any items from the house is prohibited. Locked rooms and cupboards may be reserved for the use of the apartment owner and are not included in this rental.

Some properties may have inventories of furniture, etc, therefore you should check this at the beginning of your stay at the property and you should check this again before you leave at the end of your stay to ensure that all things on the inventory at the beginning of your stay are left as described in the inventory at the end of your stay.

Should you or other members of your party or guests cause any damage to the property, its contents, grounds, or any third party, then you will be deemed responsible for such damage.

You are responsible at all times for the safety and behaviour of your children, especially with regard to swimming pool safety. Even if the pool area is fenced or has an alarm, accidents can and do happen.

Payment of Extra Services

"Taxe de séjour" – This "Tax" is a local government tax imposed on all tourists (including French ones) levied by the local ‘mairie’ to help fund tourist information leaflets, publicity for local fêtes and so on. The tax can vary from €2 per person per week to €1 per person per day depending on the area. All owners are obliged to comply with this law.

The Owner or their Representative shall charge the Guest 15€ (Euros) for each set of lost or mishandled keys. The Guest is required to follow all instructions precisely on where to leave the apartment keys on completion of your stay.

Additional cleaning services / bed linen and guest towels

Additional cleaning services (outside the standard service before your arrival) is charged at 10€ (Euros) per hour.

Bed linen and Guest towels (1 bath towel and 1 hand towel per person) are not always included in the rental cost.

Details for individual properties are stipulated on the booking form.

Insurance

You are strongly recommended to take out a comprehensive travel and health insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings etc. since these are NOT covered by the proprietors’ insurance.

Arrival & Departure

Arrival and departure days are Saturdays. The property will be ready after 4.00p.m on the start date of your rental period. Please advise if you are unable to arrive by 4pm or if you are delayed en route, you must telephone the key holder noted on the directions sheet to let them know your expected time of arrival. If you arrive at an unreasonable hour without notification and are unable to gain access to the property, neither we nor the property Owner can be held responsible for any cost incurred for alternative overnight accommodation. In some cases, the key holder does not live close to the property, and if they need to come out to welcome you after a certain time (eg. 8pm) there will be a supplementary charge to pay them.

Please do not arrive early, as time is needed to thoroughly prepare the property between lets. For the same reason please note that you should be prepared to leave the property by 10.00a.m on departure day.

The property will be clean and tidy on arrival of The Guest, who is responsible for leaving it in a similar condition otherwise charges may be made for additional cleaning. The Guest will be asked to check and sign the inventory and given an explanatory tour of the property.

On arrival the Guest will find the house provided with all the basic household products (toilet paper, dishwashing products, washing powder, washing up liquid, etc.) While the Guest has full use of these and any other dried food stuffs left for their purpose, they are asked to replace them with the same or equivalent products when they leave. A file with details about the apartment, instructions on the use of the household appliances, days for dustbin collection etc, will be in the house.

Brochures on the local area, places of interest and local activities are also available, which you are requested to keep in order and leave for the use of future guests.

Cleaning Standards

The property will be cleaned in readiness to welcome you on your arrival and you are asked to leave the property and its contents as you expect to find them – it is essential that you leave the property clean on your departure. As a minimum you are expected to leave bathroom appliances and the kitchen (all tableware, utensils and appliances like the oven and fridge) completely clean, and not to leave litter in the garden.

You are responsible for the cost of extra cleaning if the property is left in an unreasonable state and deductions will be made from your security deposit.

Breakages

Breakages or damage must be reported to our Representative, and the cost of replacement or repair will be deducted from your security deposit. If you find anything broken or damaged when you arrive at the house, please tell our representative right away to avoid problems in assigning responsibility.

The party leader agrees to accept full liability for all loss or damage caused by any member of their party, during the occupation of the apartment and confirms that the full cost of repair or replacement will be met. The sum reserved by this clause shall not limit The Guest’s liability to the Owner.

Occupancy

The maximum occupancy for each property is shown on the website and on the Booling Form and must not be exceeded under any circumstances. In the event of failure to comply with this provision, the Owner or their respresentive shall be entitled to ask you to leave the property without refund of monies paid or any other liability to you. Failure to comply with this may result in a loss of the security deposit.

The parking of caravans/pitching of tents at the property is strictly forbidden.

Conduct

We ask that you act in a considerate and courteous manner to your neighbours. We expect you to have fun but we also request that noise be kept to an acceptable level during early mornings and late evenings, particularly around the courtyard. We rent to responsible adults only; absolutely NO house parties or functions such as weddings are allowed without advance WRITTEN permission from The Owners or their Representative. We also request that due respect is given to the property and its contents.

DRUGS AND HAZARDOUS MATERIALS: The Guest and members of the party shall not use or permit to be brought into the house any illegal substances, inflammable fluids (e.g., gasoline, kerosene, naphtha or benzene), or other explosives or articles deemed hazardous to life, limb or property. There is a "No Smoking" policy for the house indoors (although we have no objection to smoking outdoors). Similarly there is a "No Pets" policy without prior written consent and agreement of The Owner or their Representative. Evidence of any of the above found on the premises will cause immediate eviction, and forfeiture of Guest’s entire rent and deposit.

Liability

In the event of any problems whatsoever the total liability of The Owner or their Representative or South France village houses . will be limited to the rental amount paid by the client.

The Owner and their Representative assume no liability for property loss or damages, nor liability for injury or accidents to The Guest or their party which occur as a direct result of insuffiicient caution used on the premises and in the courtyard. Furthermore, Guests are responsible for the house during occupancy, and must lock the doors and secure the windows and shutters at all times when not on the premises.

The Owner shall not be liable to The Guest: for any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliance in the property, courtyard or spa pool; for any loss, damage or injury, which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner; for any loss, damage or inconvenience caused to or suffered by The Guest if the property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owner shall, within seven days of notification to The Guest, refund to The Guest all sums previously paid in respect of the rental period.

South France village houses act only as booking agents for the Owner, we cannot accept any liability for any act(s) or omission(s) of the Owner or anyone representing, or employed by, the Owner. Further, we cannot accept any liability for any shortcomings or defects with or in any property as all properties are within the sole control of the Owners. If you have any complaints regarding any services we provide (as opposed to any provided by the Owner), you must inform us immediately in writing and in any event within 7 days of the end of any arrangements booked through us. We regret we cannot accept any liability if we are not so notified. Our maximum liability to you if we are found to be at fault in relation to any service we provide (as opposed to any service provided by any third party such as an Owner for whom we are not responsible) is limited to the commission we have earned or are due to earn in relation to the booking in question.

The description of the rental property and facilities at a property are based on the information provided to us by the Owner, who certifies that the information provided is correct. We may not be held liable for any fault on the part of the Owner in this regard, or for any changes effecting the rental property or its surroundings which have not been brought to our attention by the Owner before you occupy the property. Our role is limited to acting as a bookings agent and we shall not be liable as a result of any act by the Owner or you in this regard.

Neither we nor the Owner can be held responsible for noise or disturbance originating beyond the boundaries of the property or which is beyond the Owner’s control. In the event that a source of reasonably obvious noise has been in existence prior to your arrival and we are informed of this, we will contact you to inform you of the disturbance.

‘FORCE MAJEURE’: Neither we nor the Owner can accept liability in any circumstances where performance of the contract is prevented by reason of circumstances beyond our or their reasonable control, including but not limited to War or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disasters, fire, flood or adverse or bad weather conditions, acts of God, closure of ports or airports, epidemics, delay caused by a carrier company, breakdown of domestic equipment, government action or any similar events outside our control.

Maintenance

The Owner and their Representative shall make every effort to keep the house and its inventory in good working order. In case of a maintenance problem, they will strive to repair the problem as soon as possible after being notified. However, no refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, telephone service, water, pool filtration system, heating, television or cable service, appliances, etc. It is the Guest’s obligation to report any problems, damage or losses, to the Owner or their Representative, IMMEDIATELY, regardless of the hour. Authorised maintenance personnel may require access to the property, the terrace or the splash pool during your stay. We cannot deal with complaints after you have left the house if we were not made aware of them while you were there.

DATA PROTECTION

In accordance with the Data Protection Act 1998, we will ensure that the collection of personal information is fair and lawful. We take responsibility for all personal information held and used and that appropriate security measures are in place to protect this information. Some personal information may need to be passed on to third parties. We also request full details of all party members prior to departure as a safety measure whilst you are on vacation.

By requesting details of availability of properties you provide us with your consent to process your personal data, and that of the persons detailed in your enquiry form, in order to provide you with details of the proposed booking of properties. You agree to the terms of our ‘Privacy Policy’. By signing the Booking Form, you provide us with your consent for us to use your personal data, and that of the persons detailed in your Booking Form, in order for us to process the booking. You also consent for us to pass this personal data to the Owners in order to process your booking and for the Owner to provide you with the rental services in connection with the property. You acknowledge that we or the Owner may also transfer your personal data, and that of those contained in your group, to other third party providers where you have requested services to be provided by those third parties.

Please let us know if you would like your personal details to be removed from our database after your holiday. If your personal data remains on our database as you have not asked us to remove it, we may use this data to update you on products which may be of interest to you.

RATES AND PRINTING ERRORS: The information pertaining to the apartment on any rental website or information sheets was correct at the time of press, and our details are constantly updated. The Owner or their Representative is not responsible for printing errors or inadvertent omissions. All rates and apartment details are subject to change without prior notice.
